The project for the first time intends to analyse the judicature of the OGH concerning the fundamental rights from
the point of view of the constitutional law. Subject of the analysis are dogmatic as well as methodological
questions. On the basis of this analysis it shall also be examined whether from the constitutional point of view
there is a necessity of reform of legal protection. Also to be answered is the question which possibilities of reform
there are in view of the existing constitutional system. In that connection a comparison with the system of other
states will serve as a basis for the analysis.
